Welcome to FitProTech. By accessing fitprotech.ai or any of our products (DevTraq.ai, CapTraq.ai, PropTraq.ai), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the site or our services.
These Terms constitute a binding agreement between you and FIT Solutions Corp ("FitProTech," "we," "us"). We may update these Terms from time to time; continued use after an update constitutes acceptance of the revised Terms.
You agree to use the site and services only for lawful purposes and in accordance with these Terms. You will not:
Some products require an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.
All content, software, trademarks, and other intellectual property on the site and within our products are owned by FIT Solutions Corp or our licensors. We grant you a limited, non-exclusive, non-transferable license to access and use the services for their intended purpose. No other rights are granted.
Any data or content you upload, submit, or transmit through our services remains yours. You grant us a limited license to host, store, and process that content as necessary to provide the services. You represent that you have the rights to share any content you submit.
Some of our products are offered on a paid subscription basis. Pricing, billing terms, and refund policies are described at the time of purchase or in your subscription agreement. All fees are non-refundable unless stated otherwise in writing.
The services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the services will be uninterrupted, error-free, or completely secure. AI-generated outputs (e.g., site scoring, document intelligence, predictive maintenance) are for informational purposes and should not be the sole basis for investment, lending, or operational decisions.
To the maximum extent permitted by law, FIT Solutions Corp will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the services. Our total liability for any claim arising out of or relating to these Terms or the services will not exceed the amount you paid us in the twelve months preceding the claim, or US $100, whichever is greater.
You agree to indemnify and hold harmless FIT Solutions Corp, its affiliates, and their officers, employees, and agents from any claims, losses, or damages arising from your use of the services or your violation of these Terms.
We may suspend or terminate your access to the services at any time for any reason, including violation of these Terms. Upon termination, your right to use the services ends immediately. Sections that by their nature should survive termination (including IP, disclaimers, and limitations of liability) will survive.
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Florida.
